Ardit Binaj, a 32-year-old Albanian migrant, exploited a legal loophole to return to the UK after being deported following a prison sentence for burglary.

Initially entering the UK illegally in 2014, he was jailed for 2.5 years but released early.

After deportation, he returned to the UK to be with his girlfriend, who holds EU settlement status, and they later married and had a child.

Claiming that his deportation would violate Article 8 of the European Convention on Human Rights (ECHR), which protects family life, Binaj successfully challenged the Home Office’s efforts to deport him again.

Critics, including former immigration minister Robert Jenrick, argue that the ECHR has become a “charter for criminals,” undermining efforts to deport dangerous offenders.

Jenrick emphasized that the future of the Conservative Party hinges on quitting the ECHR to regain control over immigration and national sovereignty.
