Filed Wednesday in San Francisco, the lawsuit challenges Homeland Security’s order to drop Temporary Protected Status for 348,000 Venezuelans, with deportations looming by April.

They argue Secretary Kristi Noem overstepped by reversing Biden’s extension, calling it unfair, while Noem’s team stands firm—she even dubbed them “dirtbags” on Fox News.

The fight’s on as half could be out soon, with the rest at risk by September.

The Trump administration is terminating Temporary Protected Status (TPS) for over 300,000 Venezuelans, which means they can be deported within 60 days of the official notice.

This impacts half of the 600,000 Venezuelans with TPS, while the other half remain protected until September.

In January, Biden extended TPS for Venezuelans by 18 months, citing conditions in their country—a decision which the Trump administration swiftly revoked.

Homeland Security Secretary Kristi Noem justified the move, stating that TPS was no longer necessary as it did not serve the national interest.

Meanwhile, Venezuela has reportedly agreed to accept deported nationals, though Caracas has yet to comment.
