Today, Sunday, March 24, 2024, the Palestinian Authority published the Official Gazette, issue 212, which includes the announcement of presidential decrees, decisions, amendments, and ministerial decisions.

The newspaper published Decree No. (2) of 2024, regarding accepting the resignation of the eighteenth government, and accepting the resignation of former Prime Minister Muhammad Shtayyeh.

And Resolution No. (17) of 2024 AD regarding accepting the resignation of the President of the Supreme Court/Court of Cassation and Chairman of the Supreme Judicial Council, Issa Abu Sharar, and appointing “Mohamed Abdel-Ghani” Al-Awewi as his successor.

The Supreme Council for Creativity and Excellence

As for Decree No. (3) of 2024, it amended Presidential Decree No. (7) of 2012 regarding the establishment of the Supreme Council for Creativity and Excellence.

In this year’s decree, President Mahmoud Abbas amended the original decree to increase the number of members of the Board of Directors from 30 to 50 members, after the limit was 30 members in the presidential decree.

According to the decree, the Chairman and members of the Board of Directors are appointed for a period of four years, renewable once, by a decision of the Chairman of the Executive Committee of the Palestine Liberation Organization, Mahmoud Abbas, and the presidential decree granted Abbas the possibility of renewal for a number not exceeding (10) members for an additional period.

Palestinian Satellite Corporation

In Resolution No. (18) of 2024, it stipulated the restructuring of the Board of Directors of the Palestinian Satellite Corporation “PALSAT”, appointing Ahmed Assaf, supervisor of official media and head of Palestine TV, as its chairman.

Council of the Security Forces Judicial Authority

As for presidential systems, the gazette stipulated the Bylaws of the Security Forces Judicial Council No. (1) of 2024, in which the bylaws of the Council were published.

According to the bylaws, in cases of necessity, the Chairman of the Council or his deputy, in his absence, may decide to call the Council to meet on an emergency basis.

5. The Council meeting shall be valid in the presence of at least three of its members, in addition to the Chairman or his deputy in the event of his absence. Decisions shall be issued by the Council by a majority of all its members present, and when the votes are equal, the side with the Chairman of the session shall prevail, and the Council’s sessions and deliberations shall be confidential.

In January 2024, a decree-law was issued amending Decision-Law No. (2) of 2018 regarding the judicial body of the security forces, amending Articles 11, 12, and 13 of the first decision, in terms of forming one or more central/special/permanent military courts, according to As the case may be, by an individual judge, provided that his rank is not lower than captain, by decision of the Supreme Commander and upon the recommendation of the head of the body, until the formation of the court becomes a decision of the Council that determines the spatial jurisdiction of each, and it is held by an individual judge.

The decree-law issued in January granted President Mahmoud Abbas the possibility of establishing other military courts of appeal according to the need, upon the recommendation of the Council, according to which the spatial jurisdiction is determined according to each of them.

Appointment of new governors

In the Al-Waqa’i newspaper, a decision was issued regarding the appointment of Khaled Dudin as governor of Hebron Governorate, the appointment of Kamal Abu Al-Rub as governor of Jenin Governorate, a decision regarding the appointment of Ghassan Abu Bakr “Daghlas” as governor of Nablus Governorate, and the appointment of Hussein Hamayel as governor of Jericho and Al-Aghwar Governorate.

The newspaper also published a decision appointing Ahmed Saleh as governor of Tubas and the northern Jordan Valley, Muhammad Abu Alia as governor of Bethlehem Governorate, Hussam Abu Hamdiyeh as governor of Qalqilya Governorate, and Mustafa al-Derawiyah as governor of Tulkarm.

Adding terrorists to the terrorist list and imposing sanctions on North Korea

In it, the newspaper published the names of Israeli settlers, regarding the inclusion of an Israeli terrorist entity and individuals on the national listing list proven to have committed, participated in, or facilitated terrorist acts, and that was limited to (15) individuals and one entity.

It published Resolution No. (5) of 2024 AD implementing UN Security Council Resolution No. (1718) of 2006, in accordance with the decision of the Sanctions Committee dated 03/08/2024 AD, and in accordance with Resolution No. (1) of 2022 AD of the Committee for Implementing UN Security Council Resolutions, which includes the implementation of Resolution UN Security Council concerning the Democratic People’s Republic of Korea.

With the issuance of decrees by law, controversy arises in the legal community and the Palestinian street, about what the executive authority, represented by the president, aims to achieve through a series of decrees by law issued by the president at a time when the Legislative Council, the authority entrusted with issuing laws and legislation in the Palestinian territories, is absent.

Article 43 of the Palestinian Basic Law stipulates that “the President of the National Authority may, in cases of necessity that cannot tolerate delay when the Legislative Council is not in session, issue decisions that have the force of law, and they must be presented to the Legislative Council in the first session it holds after the issuance of these decisions.” Otherwise, it would cease to have the force of law, but if it was previously presented to the Legislative Council and it was not approved, it would cease to have the force of law.”
